School Residency Rules Require Tough Decisions

Students who live in a house or apartment with more than one family because of economic hardship, i.e. “doubled up,” are legally homeless under federal law (McKinney-Vento Homeless Education Act). This may not be this situation in this case, but this important legislation may pertain to others. A homeless student is entitled to enroll in his/her neighborhood school - without documention, including proof of residency. If a school is impacted, he/she may be overflowed to another school. A homeless student may continue in the school in which he/she was last enrolled for the duration of the school year, even if he/she moves outside of the school district boundaries. This helps to provide stability for homeless children whose lives are otherwise often very challenging and unpredictable.
